With content based on CTT Group’s direct experience of “defending” trusts. Friday 7th and Monday 10th October 2022.
What we will cover:
- The importance of risk management at the instruction taking stage. Information gathering is very important at the point of instruction, especially when it then comes to defending a trust that the client has implemented. However, your file notes are often not enough. The voice of the client needs to be heard and we will show you how you can give your clients the best chance.
- Preferred trust structures that lend to a more robust defence. Trusts that give a strict right for a beneficiary to benefit from it can be exceedingly difficult to defend if it’s that beneficiary who has an issue. Trustees need discretion. We will demonstrate how to deal with these contentious matters.
- A brief insight into the nuts and bolts of trust defence. A quick look at the generics of how trust claims often come about and the initial steps that need to be taken to ensure defence. CTTC use bespoke techniques to protect trust assets and we will give you an introduction as to how we would implement these.
- A run through of some of the cases that CTTC have been involved with. How we have dealt with a variety of difficult circumstances efficiently. Examples of common situations that can be encountered when defending trusts. An opportunity to see cases based on real life examples.
