We understand that the decisions your client make in relation to their Estate Planning are based on what they believe best suits them and their family.

Our Client Disclaimer identifies any areas of concern and the implications in relation to your client’s proposed estate planning.

An example of an identified risk could be that secure storage has not been ordered.

If your client decides against using a Secure Storage Facility, a thorough explanation of the risks incurred will be presented in the Disclaimer, which results in a better client understanding.

After the client has read the risks involved and you have discussed the potential consequences that might arise if they do not order secure storage, the client will have to confirm that:

  • They fully understand the consequences.
  • They are happy to proceed on the basis of their instructions and the list of concerns.

Following this, if the client ultimately decides to act against your recommendations (such as not using storage, any tax implications or any other concerns you may elect to add in yourself), the client confirms their understanding by signing electronically.

Once the disclaimer has been electronically signed, this will help to mitigate against the possibility of any future complaints and legal challenges to the advice given by yourself but not taken up.
