High Court judge calls for awareness around ‘living wills’

‘Living wills’ have been put forward by a High Court judge in order for people to set out their wishes should they be struck by an incapacitating illness.

Highlighting a need for people to be educated about living wills, Mr Justice Francis stated that they would resolve cases where someone is lacking mental or physical capacity.

His proposals were suggested during a hearing in the Court of Protection where a decision was being made over the treatment of a man in a minimally conscious state.

In order to come to a resolution more quickly in cases such as this, he touched on the need to boost awareness and encourage people to consider making a living will.

“It should be compulsory that we all have to make living wills because these cases would be resolved much more easily.

“We all ought to be encouraged to tackle these issues.

“If there was some sort of campaign to educate people about these sort of things I think people would actually do something about it.”
