It’s no secret that regulation within our sector is subject to scrutiny.
Just last year the law surrounding Wills was described as outdated, with recommendations made for it to be brought into the “modern world”.
That’s not to forget the probate proposals put forward by the Ministry of Justice, suggesting the current probate fee structure be replaced with a sliding scale correspondent to the value of the estate. With the maximum total cited at £20,000, it wasn’t long before the proposal came under criticism from both professionals and the parliamentary committee, who challenged its legal basis. Whilst the plans for its implementation are currently on hold, it’s unclear whether it will come into force in future.
The end of the year brought a further announcement from the Law Commission regarding trusts; namely that the law surrounding them would feature in its 13th programme of reform. As well as aiming to identify areas of trust law which would benefit from modernisation, the scoping project sets out to improve competitiveness on an international scale.
